HIPAA Compliance Agreement
This HIPAA Compliance Agreement (the "Agreement") outlines the responsibilities and obligations of users ("Users") of the Inspire Webapp (the "iwapp"), which provides artificial intelligence-based intervention and documentation of clinical notes. By accessing or using the Webapp, you agree to comply with the terms of this Agreement.
Definitions
1 Protected Health Information (PHI) refers to individually identifiable health information as defined by the Health Insurance Portability and Accountability Act (HIPAA).
2 User refers to any individual or entity accessing or using the Webapp.
Webapp's Compliance with HIPAA
1 The Webapp does not store any information in its database. While it is designed to facilitate documentation of clinical notes, it does not retain or archive any user-generated content or data once the user session ends.
2 The Webapp has implemented appropriate technical, administrative, and physical safeguards to ensure the confidentiality, integrity, and security of electronic protected health information (ePHI) processed or transmitted by the Webapp.
User's Responsibilities
1 Users should not input, upload, or otherwise provide any PHI or sensitive information that would be in violation of HIPAA or any other applicable laws.
2 Users are responsible for ensuring that they have the necessary consents and permissions to upload, share, or process any data or information through the Webapp.
3 Users must immediately report any unauthorized access, use, or disclosure of PHI to the Webapp's support team.
Limitation of Liability
1 The Webapp's primary function is to provide artificial intelligence-driven insights and facilitate the documentation process. Users should exercise their judgment when using the Webapp's outputs in any clinical decision-making process.
2 The Webapp is not responsible for any violations of HIPAA or other laws that may result from the user's actions, omissions, or decisions based on the Webapp's functionality or recommendations.
Acknowledgment and Acceptance
By using the Webapp, the User acknowledges:
1 They have read and understood this Agreement.
2 They agree to comply with all terms and conditions outlined herein.
3 They understand the importance of safeguarding any sensitive information and the potential ramifications of a HIPAA violation.
This Agreement may be updated from time to time to ensure continued compliance with regulatory standards and best practices. Users are encouraged to regularly review this Agreement for any updates.
